- Marsdens Cottage Holidays ‘the Agents’ act only as agents for the Owners of the property, and are not Principals. ‘Applicants’ is the term used for those clients wishing to hire a property, and ‘Tenant’ is the name given to those applicants who have taken up residency at a property. Any contract is between the Owners of the property on one part and the Applicants or Tenants on the other.
- Deposits - Bookings can only be accepted in writing on the agents official booking form or through our website. A deposit of one third of the total rental, calculated to the nearest pound, plus £12 booking fee, should be sent with the booking form. In the case of bookings made within 8 weeks of the commencement of the holiday the full amount should be sent with the booking form.
- Final Payment - Once the booking form is received and accepted by the agents, the applicants are liable for payments of the balance of the rent, plus any additional charges, 8 weeks before the holiday commences. The balance of the rental must be received by us no later than 8 weeks before your holiday commences. On receipt of the balance, full details of key collection arrangements and directions to the property will be sent. Please note we do not send reminders.
- Cancellation Plan - Cancellation should be notified by telephone as soon as possible and confirmed in writing or by email within seven days of the event leading to a cancellation. Our cancellation plan offers a full refund of rental less a £50 administration fee plus VAT in the event of cancellation due to death, injury, illness, or summons for Jury Service of any member of the party; or close relative or business associate of the Applicant which may reasonably prevent the Applicant taking their holiday. The term close relative applies to Husband, Wife, Father, Mother, Father in law, Mother in law, Brother, Sister and Children. Our cancellation plan does not cover pregnancy or any associated illness. Any illness or injury which in the opinion of the agent, is insufficiently serious to prevent the person taking up their holiday is not covered. Neither does it cover cancellations which arise where the Applicant at the time of booking was aware of any illness or medical condition, this also includes Applicants who at the time of booking were on a hospital waiting list awaiting an admission date. Doctor’s certificates need to be provided and sent to the Agents, when no further payments will be due and any previous rental payments refunded (less a £50 administration fee plus VAT). Our cancellation plan terminates by 12 noon on the day prior to commencement of holiday. Should you wish to have additional cover for redundancy for example, please make your own arrangements for additional cover. Members of HM Forces, the Police Force and others whose conditions of service may involve being posted at short notice are also advised to make their own provision to cover this possibility. - Cancellations not covered by the cancellation plan - When the cancellation is for a reason not covered by the scheme outlined in 4. above the balance is still due on the due date. The agents will make every effort to re-let the property and where this is possible will refund the rental. In all cases there will be an administration fee of £75 plus VAT.
- Price Alterations - The Agents reserve the right to adjust prices quoted in the brochure, on our website or on details to properties due to errors or omissions or changes in V.A.T.
- Method of Payment - Payments can be made by cheque made payable to Marsdens Cottage Holidays. Payments by credit card are subject to a 2% surcharge. No surcharge for debit cards.
- Size and Party - The number of persons stipulated for each property in the brochure must not be exceeded under any circumstances. Only those listed on the booking form may occupy the premises. We normally class infants as being 2 years old or under. The person who completes the booking form certifies that
- The signatory is authorised to agree to the booking conditions on behalf of all persons on the booking form including any changes.
- The signatory must be over 18 years of age and a member of the party occupying the property.
- The signatory has agreed to take responsibility for the occupying party.
- Eligibility - Bookings cannot be accepted from all male or all female parties, and where exceptions are made the Agents reserve the right to take a £20 per person damage deposit. Please see section 18 for damage deposit information.
- The cottage summary details aim to give accurate descriptions of the properties. Should there be any specific health or mobility difficulties which may affect a party member, we request that this is pointed out at the initial reservation stage so the suitability of the property can be established.
- Tenant Obligations -
- Tenants agree to take reasonable care of the property and ensure that the property and all equipment is left clean.
- Tenants agree to pay for any losses or damages to the property (except reasonable wear and tear) unless the costs can be fully recovered under the owner’s insurance.
- To pay for any optional extras at the rate stated in the brochure.
- To allow the Owners and Agents reasonable access to the property.
- Tenants agree not to exceed the total number of persons in the property as stated in the details and on the booking form, or share the property, or part with possession of the property.
- Tenants agree to accept responsibility for safety of any pets. At no time should a pet be left alone unsupervised at the property. A charge will be made of £15.00 each per week.
- Should the property, for reasons beyond our control or the Owners (e.g. Fire, Theft, Sale etc) not be available on the date booked or the property is not available for holiday letting all rent and any charges paid in full by the Applicant will be refunded in full. The Applicants will have no further claim against the Owner or the Agent.
- The Agents accept no liability for any act, neglect or default on the part of the Owners or any person not within their employ, or otherwise under their control, nor for any accident, damage, loss, injury, expense or inconvenience whether to person or property, which the Tenants or any persons may suffer or incur that arise out of the letting, or is in any way connected with the letting.
- The agents cannot accept a change of holiday property or details to a booking once the deposit has been received. However, occasionally we can accept a change of holiday weeks where the owner of the property will agree to an alteration of dates. Where any changes, for example changes in party size or additional pets, are made, a minimum administrative fee of £25 plus VAT will be charged.
- The agents aim to ensure that any information provided by property owners is accurately conveyed in the brochure and the website. There may be small differences as we ourselves are always improving our service and facilities. Any changes will be notified to you as reasonably practical after we have been made aware of the situation. We cannot accept responsibility for any changes or claims to the area amenities mentioned in our brochure or by our holiday staff.
- All complaints must be notified to the Agents immediately so that they can investigate the circumstances, and take any necessary action. In no circumstances can compensation be made for any complaints that are made after the tenancy has ended, or where the Tenant has denied the Agents or the Owners the opportunity to try to put matters right during the tenants stay.
- Damage - Occasionally accidents do happen and any losses must be paid for. Properties are checked and cleaned before arrival but if you have any difficulties please contact your housekeeper, whose details will be in the property. Should you find on arrival any damage or non-working items it is important to notify the housekeeper immediately so that matters can be rectified.
- Refundable Security Deposits - A few of our owners require us to take a security deposit on all bookings. Where this is the case, payment will be taken with the balance of the holiday. Details will be given in the property description. A security deposit may also be requested by an owner where for example an extra pet is allowed at the property. Occasionally where a booking is accepted for a group of friends taking a holiday together the agent reserves the right to take a £20 per person security deposit or an amount as agreed with the owner. In normal circumstances all security deposits will be refunded within one month of the holiday.
- VisitBritain - We observe the VisitBritain Code of Conduct and in the event of any complaint reserve the right to refer the matter to VisitBritain for arbitration. All our properties are inspected and graded by a VisitBritain assessor.
- We cannot accept responsibility for any items left behind in your accommodation after your holiday, and would advise you to contact directly the houskeeper/owner of the property. Any unclaimed items will be disposed of after two weeks.
- This brochure and conditions supersede all previous issues.
